The Federal Communications Commission held its Open Commission meeting today with a very fierce and forbearing agenda. Furthermore, the itemized agenda wasn't fully activated until now. In 90 years, it is time for the FCC to spark more than a broadband adoption for comments. Commissioner Brendan Carr did signal his disdain for the 11th hour protocols that would enhance more than enforcement rules and regulations for the FCC. The concern arises because of the latency of Congress for 12 years with limited to no spectrum outlooks for innovation which has made the existence of the FCC the subject matter for regulating the entire Internet along with its service providers and sales pitch.
Efforts to promote equal access to broadband internet access services by preventing digital discrimination based on income level, race, ethnicity, color, religion, and national origin. Empowering Survivors of Domestic Violence, Understanding Impacts of Artificial Intelligence on Robocalls and Robotexts, and Protecting Consumers from SIM Swapping and Port-Out frauds were a few of the agenda topics for today's meeting discussion. "I hope you have a good lawyer," was one of Commissioner Brendan Carr comments with regards to what the Biden-Harris Administration has tasked the FCC with in the regulations prompts. The Democrats in particular and specific have imposed an authority on the agency which has no interest in regulating such as broadband rates and pricing. According to the Communications Act, Congress was able to distinguish between rates and regulations however, they have forgotten that handle. In 1996, the FCC was striped of rate regulation authority for a more expansive approach. With implementation of Section 6506, new punitive liabilities arise which create barriers to equal broadband access because ISP are compelled to build out infrastructure without compensation. The legal matter is lingering but the statue is clear that price nor affordability were phrases that sparked any fiber optic connection for Congress considering only terms and conditions clauses as they have now tasked the FCC with a vast duty and obligation beyond the broadband spectrum.
