Senate Bill 0516 introduced by Senators Feldman and Hayes sure went through its germinating phase to get flowers on the shelves at dispensaries in the near future during the Finance Committees voting session held today. All 16 of the amendments were passed by an overwhelming majority of 7-2. The purpose of SB0516 is to rename the Alcohol and Tabacco Commission to be the Alcohol, Tabacco, and Cannabis Commission establishing a regulatory and licensing system for adult-use cannabis under the Commission. Along with imposing the sales and use tax on the sale of adult-use cannabis at certain rates in certain fiscal years. This bill by far wasn't an easy task for the Committee. The conversation was very cloudy at times and required some clarity to certain amendments which will be regulated by the Cannibals Division or Administration which will operate as an independent governing body.
Social equity generated much buzz during the discussion of Amendment 9 which highlights those impacted by disproportionate enforcement of the cannabis. Those applicants will be afforded the opportunity of a social equity license through a partnership grant program which will promote between operational cannabis licensees. This amendment would also ban internet sales and allowing for 10 micro dispensaries. These micro dispensaries would be required to make shelf space available for other growers, and incubator licenses changes. Senator Hayes raised a concern about buffer zones to prevent clumping of dispensaries. In which the bill stipulates that no dispensaries are to be located with 1000 feet of each other, at least 500 feet from school, libraries, and those that exist in a proper zoning area do not have to comply. This amendment was very apprehensive for Senator Ellis who was "concerned about cannabis dispensaries like liquor stores near places of worship." He wanted to include the church in the buffer zone, but some constitutional concerns come into the playing field with religion. Furthermore, some constituents do view cannabis as a holy sacrament along with that a form of their religious practice and belief systems. Considering the language of SB0516 was a little cloudy a times, Chair Melony Griffith informed the Committee that the House had been collecting data since 2010, which took into consideration those impacted by zip code in the number of possession arrest in those areas. Under Amendment 10 drug testing would still apply in some aspect. Amendment 12 would require the Cannabis administration to provide updates on how dispensaries will operate and set limitations on canopy growth to 20 percent. The amendment will allow for cannabis business to have a sign on property, and it defines THC along with tinctures. "What happens with onsite consumption?" A question which instantly turned the Committee's high grade cannabis conversation to something of a mid-grade not even found at the local gas station. There was also concern if the onsite consumption entity would have an opportunity for a restaurant also and which licenses would be applied in that area. Senator Kramer did have some objections to that amendment considering a license shouldn't be a loophole for printed money which he refers to as revenue from the cannabis industry. The onsite consumption question raised concerns for laws which prohibit tobacco smoke despite constituents voting to legalize marijuana for recreational use. The language in the bill allowed for exemption from the clean air act which is similar to cigar bars. A separate license would afford the exemption status- that's until Senator Clarence Lam suggested an amendment to the bill. Senator Dawn Gile suggested at the voting session "if we have authorized this by this law it's a little bit of discomfort for lack of clarity with some ambiguity raised. I'm concerned about it, just my comment." "Can onsite consumption license allow you to sale cannabis or authorized to sale only to people on site?" Was the question asked by Senator Stephen Hershey. He was "trying to find the business model," among all the smoke. Unfortunately, the Committee cannot regulate use of product in onsite consumption facilities. Senator Lam said that it's important to know that "cannabis smoke carries same risk as cigarette smoke and gives me tremendous amount of pause here from departments intentions on clean indoor air act which is creating a loophole in the clean air act." Senator Pamela Beidle shared the same hesitation as Senator Lam in that micro licenser would be able to operate onsite consumption entities with exemption from clean air act. Vicechair Katherine Klausmeier said "I never wanted it in the first place. I'll just go to the bars where they just have beers that's it," in relation to the onsite consumption discussion. The onsite consumption clause came about for multi-family dwellings and aromas in close proximity to the next room or neighbor. The amendment was first struck down at the food service facility operating in the onsite consumption establishments and this portion of the bill was clearly going backwards in the clean air efforts so the exemption would be the next to go. In a hypothetical scenario Senator Ready asked "is smoking the only way to consume cannabis?" He imagined that gummies were tasty from their appearance. However, he doesn't want to decide for someone how to consume. The Committe reached a consensus on the vote to consider one for the restaurant portion to have a license along with onsite consumption wouldn't be able to smoke inside the establishment but at the exterior of the building should be permitted. The taxes collected from the Cannabis Reform will allocate 35% to the Community reinvestment fund, increase the public health fund by 5% with the states sale tax at 9%. Senator Hershey suggested that the local governments in all fairness should receive 3% of the sales tax also. As long as you have anywhere from $150,000 to $2 million then you are able to enter your business into the lottery for a license. Only 50 will be granted in the entire state of Maryland.
